The Site is an online store that sells imported nail care products.

All prices on the Site are in Israeli shekels (ILS). Prices include VAT, if applicable, and do not include shipping charges.

Popnail may update prices and shipping charges at any time without notice. The price in effect at the time you place your order will be the price that applies to your order.

Popnail may offer promotions, discounts, and other offers on the Site. Popnail may modify, terminate, or change these promotions, discounts, and other offers at any time without notice.

Courses
Online Courses

This website offers a variety of courses for learning manicure and pedicure. These terms of service are a binding agreement between Popnail and the person who orders a course on the website for themselves or their child or other minor dependent. The agreement also applies to the minor user for whom the course was ordered, with the approval of their parent or guardian
Course Terms
These Terms of Service apply to all courses offered by Popnail, Inc. (the "Company").
10.1 The use of the masculine/feminine form in these Terms of Service is for convenience only and these Terms of Service apply equally to both genders.
10.2 All of the information you receive in my courses, both practical and theoretical, was collected over a long period of time through learning, practice, and a significant financial investment, all so you can understand the material in the best possible way and in the best possible way.
10.3 All of this knowledge is for your personal use only and cannot be transferred to any other entity.
10.4 It is strictly forbidden to copy, print, duplicate, publish, translate, teach, sell, market, or/and transfer the contents even in part, whether free or paid, to any other entity without the written permission of Popnail signed by Polina Pkar.
10.5 You agree that during the course you may be using products/tools that will be provided to you by Popnail and any use you make of them is at your sole risk!
10.6 Do not use products/tools during the course if you are sensitive to any of the ingredients. Discontinue use immediately if you experience any signs of irritation. Use cosmetics only for the purpose for which they are intended and according to the instructions for use. (All information and tips are not a substitute for medical advice and are the responsibility of the user only.)
10.7 Popnail will not be liable for any damage that may be caused as a result of using the products or during the process of preparing them during and after the course.
10.8 If you purchased raw materials through the course, your money will not be refunded if you opened the raw material kit.
10.9 Registration for a course is subject to availability, the company's policy, and its sole discretion. Courses are opened with a minimum number of registrants.
10.10 In-person courses are held in a classroom on predetermined days and times.
10.11 The company has the right to use photos and videos of the courses in which the registrant participates in various marketing activities, at its sole discretion. The registrant agrees without limitation to such use, without any compensation, and without exception.
10.12 If it is found that the registrant is not suitable for studies in the course for any reason, the company may terminate his or her studies immediately, at its sole discretion, and without the registrant having any claims or lawsuits. In this case, the company will refund the registrant the proportional amount of the tuition fees.
10.13 All rights to the course content and all accompanying materials are the sole property of the company and are protected by copyright laws.
10.14 The company reserves the right to terminate or cancel a course for any reason or even without reason, at its sole discretion, under the following conditions:
- In the event of a course cancellation before its start, the registrant will be given a full refund. - In the event of a course cancellation after its start, the registrant will be given a partial refund in proportion to the number of lessons that actually took place.
10.15 The registrant hereby agrees that his or her details will appear in the company's databases, including for the purpose of sending messages, including marketing and promotional information, and waives any claim in this matter against the company, including under the Privacy Protection Act, 1981 and the Telecommunications Law (Telecommunication and Broadcasting), 1982. The company is entitled to allow access to the information in the databases and/or transfer the information to third parties.**
Courses
כללי
13. האמור בתקנון זה בלשון זכר/נקבה הוא לשם הנוחות בלבד והתקנון מתייחס לבני שני המינים באופן שווה.
13.1 תקנון זה מהווה הסכם מחייב בין המועדון (להלן: "המועדון") לבין המשתמשות בו (להלן: "המשתמשת").
13.2 השימוש במועדון כפוף להסכמתך לתנאים המפורטים בתקנון זה. אם אינך מסכימה לתנאים, הינך מתבקשת שלא להשתמש בשירותי המועדון.
הצטרפות ורכישת המועדון
14 רכישת מנוי למועדון מתבצעת דרך דף הנחיתה או פלטפורמת האתר בלבד.
14.1 בעת ההצטרפות למועדון, המשתמשת תידרש לספק פרטים אישיים (כגון שם מלא, דוא"ל, פרטי ואמצעי תשלום).
14.1.1 באחריות המשתמש לוודא כי הפרטים שמסר במסגרת ההתקשרות/הרשמה נכונים ומדויקים, וככל שנדרש, עליו לעדכנם כך שיהיו נכונים ומדויקים בכל עת. החברה רשאית לשנות את הפרטים הנדרשים לשם הרשמה לשירות או כתנאי להמשך צריכתו.
14.2 התשלום עבור המנוי הוא תשלום חודשי קבוע, אלא אם צוין אחרת במפורש.
14.3 מחיר השירות/המנוי עשוי להשתנות מעת לעת לפי שיקול דעתה של חברת פופנייל והמחיר התקף הוא זה שמוצג בעת הרכישה במסך הסליקה. (בכפוף לתעריפי ולשערי המטבע של חנויות הרכישה/חברות הסליקה).
14.3.1 במקרה של שינוי במחיר השירות תינתן על כך הודעה מראש. אין בכך כדי לגרוע מזכותך לבקש לסיים את ההתקשרות עמנו בכל עת. אם ישתנה שיעור המע"מ, יחול השינוי על התעריפים, בכפוף לכל דין, והדבר לא ייחשב לשינוי תעריף.
14.4 לאחר בחירת המנוי יועבר המשתמש לתהליך התחברות עם מייל. ככל שלמשתמש אין חשבון, עליו ליצור חשבון ובסיום יצירת החשבון/ההתחברות יועבר למסך התשלום באתר לשם ביצוע התשלום.
14.5 לאחר השלמת התשלום, תוענק למשתמשת גישה לאזורי התוכן המיועדים לחברות המועדון בלבד.
14.6 הנך מסכים בעצם הצטרפותך לשירות לקבל חשבונית אלקטרונית וא/ו בSMS ולא נהיה מחויבים במשלוח חשבונית פיסית לבית הלקוח.
14.7 החברה רשאית שלא לאפשר תקופת מבצע או הטבה (לרבות תקופה בה לא יגבו דמי מנוי) עבור אותו מנוי / ת.ז./ כרטיס אשראי, יותר מפעם אחת.
תוכן ושירותי המועדון
15. המועדון מספק גישה לתכנים מקצועיים, הדרכות, הטבות והנחות לרכישת ציוד מקצועי, וסביבה קהילתית תומכת.
15.1 התכנים המועלים למועדון הינם לשימוש אישי בלבד של המשתמשת, ואינם ניתנים להעתקה, הפצה, שיתוף או מכירה ללא אישור בכתב מהמועדון.
15.2 אנו נהיה רשאים לשנות בכל עת את תכולת השירות, מתכונתו, התכנים המוצעים בו, סוגיהם והיקפם. בכלל כך נהיה רשאים להפסיק לספק תכנים מסוימים. כמו כן, נהיה רשאים להפסיק את השירות או חלקו, לנתקו, לשנות את תנאיו, לקבוע או להוסיף מגבלות שונות או לצמצם את היקף השירות. שינויים אלו לא יקנו לך זכות לבקש ביטול או הפחתה של התשלום, ואולם אין בכך כדי לגרוע מזכותך לבקש לסיים את ההתקשרות עמנו בכל עת.
15.3 לא נוכל להתחייב כי השירות יתמוך בצפייה בכל תוכן, לרבות בכל מכשירי הקצה, או באיכות צפייה מסוימת, לרבות מקום בו יופיע סמליל HD ו/או כל סמליל אחר המציין איכות צפייה קיימת או עתידית. לידיעתך, ייתכן והתוכן המועבר במסגרת השירות יועבר בשיהוי או באיכות פחותה.
15.4 בכל מקרה של תקלה בקבלת השירות, תוכל לפנות למוקד התמיכה הטכנית שלנו. (אימייל popnailcompany@gmail.com)
15.5 האחריות על צפייה בתכנים היא על המשתמש בלבד, והחברה לא תהיה אחראית לצפייה בתכנים שאינם מתאימים לצופים בגיל מסוים, ולא יהיה בצפייה כאמור כדי להקים למנוי זכות לפיצוי כלשהו.
זכויות קניין רוחני
16. כל התכנים המוצגים במועדון, לרבות טקסטים, גרפיקה, וידאו, קורסים דיגיטליים ותכנים אחרים, מוגנים תחת חוקי זכויות יוצרים וחוקי קניין רוחני אחרים.
16.1 חל איסור מוחלט על העתקה, ו/או שידור ו/או הקרנה ו/או השמעה ו/או ביצוע פומבי, הפצה, פרסום מחדש או שימוש בתכני המועדון ללא אישור מפורש ובכתב מהמועדון. * הפרת סעיף זה עלולה לגרור צעדים משפטיים.
16.2 השימוש בשירות מותר באופן אישי בלבד. אתה מחויב לא למסור את פרטי ההזדהות לשירות לצד שלישי.
ביטול מנוי
17 המנוי יתחדש מדי חודש עד שיבוטל על ידי המשתמש.
17.1 ביטול המנוי ייכנס לתוקף בתום החודש שבו התקבלה הבקשה.
17.2 יובהר, כי ביטול מנוי במהלך מחזור חיוב לא יזכה בהחזר עבור החלק היחסי של אותו מחזור חיוב. (לדוגמה, מנוי שהתחיל ב-10.4 ונשלחה בקשה לבטלו ב-20.4, יסתיים ב-10.5 והמנוי לא יחוייב בגין החודש שתחילתו ב-10.5.)
17.3 לא יינתן החזר עבור תשלומים בגין התקופה שבה נעשה שימוש בשירותי המועדון.
17.4 ביטול המנוי יכולה להתבצע בדרכים הבאות:
17.4.1 ביטול העסקה דרך מייל וא/ו טלפונית בלבד: popnailcompany@gmail.com (על ידי שליחת הודעה רשמית לביטול חתומה על ידי המשתמש, בצירוף תעודת זהות, טלפון, שם משתמש באתר, וכתובת איימיל)
17.4.2 לחלופין, נתן לשלוח את אותה הודעה רשמית גם לטלפון 052-7011619
17.4.3 ככל שביקשת לבטל את המינוי/להתנתק ולאחר שזיהינו אותך באמצעות המכתב הרשמי אותו שלחת, נמלא את בקשתך לסיום ההתקשרות וזאת תוך 3 ימי עבודה מעת קבלת הבקשה, הכל בהתאם להוראות חוק הגנת הצרכן, התשמ"א-1981 ("חוק הגנת הצרכן").
אחריות ושימוש בשירותים/נתונים
18 המועדון אינו אחראי לנזקים ישירים או עקיפים שעלולים להיגרם כתוצאה משימוש בתכנים או בשירותי המועדון.
18.1 המשתמשת אחראית לוודא שהשימוש בשירותי המועדון נעשה בהתאם לחוקים החלים במדינתה.
18.2 מובהר כי האתר עלול לצרוך תעבורת נתונים וביצועים טכניים ממכשיר הקצה בו נעזר המשתמש.
18.3 אנו נהיה רשאים לנתק או להגביל זמנית את השירות אם הדבר מחייב לשם ביצוע פעולות תחזוקה או שדרוג במערכת.
18.4 החברה ו/או מי מטעמה לא יהיו אחראים, ולא יישאו, במישרין או בעקיפין, בכל נזק, ישיר, עקיף, תוצאתי או מיוחד, כספי או אחר, שנגרם למשתמש או לצד שלישי כלשהו עקב או כתוצאה משימוש או הסתמכות על מידע ו/או שירות שמופיע במסגרת השירות (לרבות באתר האינטרנט), לרבות הפסד הכנסה ו/או מניעת רווח שייגרמו מכל סיבה שהיא.
18.5 הנך מתחייב לשפות את החברה, עובדיה, מנהליה או מי מטעמה בגין כל שימוש שייעשה בשירות בניגוד להוראות תנאי השימוש או בניגוד לדין, ובכלל כך במקרה של כל תביעה, דרישה, נזק, הפסד, אבדן רווח, תשלום או הוצאה שייגרמו להם – ובכלל זה שכ"ט עו"ד והוצאות משפט – עקב הפרת תנאי שימוש אלה ו/או הפרת החוק על ידך.
פרטיות ,אבטחת מידע, שינויים בתקנון
19 המועדון מתחייב לשמור על פרטיות המשתמשות ולא להעביר מידע אישי לצד שלישי ללא הסכמה.
19.1 המועדון שומר לעצמו את הזכות לעדכן או לשנות את התקנון בכל עת.
19.2 הודעה על שינויים תישלח למשתמשות בדוא"ל או תתפרסם באתר המועדון.
סמכות שיפוטית
20 דיני מדינת ישראל יחולו על הסכם זה, על המסמכים הנזכרים בו או הקשורים אליו ועל הנובע ממנו. מקום השיפוט הייחודי בכל הקשור בהסכם והנובע ממנו הינו בית המשפט המוסמך בישראל.
